尊敬的
      自我司与贵司合作以来,我司非常珍惜和重视与贵司的合作机会,在过去的2010年中,我司本着认真,严谨的合作精神和态度,努力完成贵司下达给我司的订货计划;作为私营企业,我司相比国营企业基础薄弱,但我们仍以百分之百的工作热情,兢兢业业的控制每一道生产工序,严格按照贵司的要求完成生产计划,希望能在与贵司的合作中不断的提高自己,并期待与贵司展开更深入和全面的合作。
      
对于2010年贵司发现的我司的无效产品,我司在此表示深深的歉意,但对于贵司对我司做出的处罚决定和内容,我司有以下不同意见:
1.  贵司发现我司的无效产品属不同的生产批次,我司对贵司未在发现质量问题的第一时间将问题反馈我司表示难以解释,如果贵司第一时间反馈问题,相信以我司对贵司的合作态度和重视程度,我司肯定会在最短时间解决问题,而不至于将索赔累积到难以让我司接受的地步。
2.  贵司发现并确认的15件无效产品。我司没有异议。但我司对贵司工厂15件产品产生的120小时工时费表示难以理解和接受。
3.  作为一个和贵司刚刚开始合作的供应商,我司在产品单价几乎没有任何利润的情况下,并在2010年底配合贵司完成了贵司的降价要求,但贵司15件120小时3036欧元的罚款是我司单件的21倍处罚,让我司难以承受,且严重打击了我司合作的积极性。
4.  接到贵司的质量问题反馈后,我司第一时间分析了存在的问题并采取了整改措施,增加了二次气密这一双保险的工序步骤,从实际情况看,有很明显的效果,有效的控制了一次气密后产生的漏网之鱼。

基于上述理由,我司向贵司提出一下申述:
一、  请贵司酌情考虑免撤销贵司在2011年初开出的索赔决定。
二、  请贵司根据我司的实际情况,重新考虑并确定零公里退货率、次品率、及三包退货率和相关的索赔比率及系数。
